Terms of Participation

General Rules

Eligibility: Participation in Giving Day for Apes is limited to organizations that care for apes in a sanctuary/rescue center setting and that (a) are legal non-profit entities within the United States and have tax-exempt status as a public charity under 501(c)(3) of the Internal Revenue Code; or (b) have an approved fiscal sponsor with such status. 

Donations: Only donations made online through the Giving Day for Apes website will be counted towards leaderboard totals and other prizes. A participating organization may not make a donation to its own fundraising page to help secure a prize. Any individual, including personnel employed by or affiliated with a participating organization, may donate. Only the authorized credit card holder may donate on the Giving Day for Apes website. A third party may not use the donor’s card information to make donations on behalf of the donor, and participating organizations may not encourage an individual to make donations using multiple email names or email addresses in order to increase unique donor total. 

Donations received by participants either offline or through other online platforms may not be "passed through" to the participant's fundraising page on the Giving Day for Apes website, by having anyone on behalf of the participant make an online donation to the Mightycause Giving Day for Apes website in the amount of the offline donation received. Such donations may be added as "offline donations" to the participant's fundraising total for the event, but in the spirit of the prize competition will not be added to leaderboard totals.

Mightycause and Global Federation of Animal Sanctuaries have the right to verify all donations in compliance with these rules.

Disqualification: Mightycause and Global Federation of Animal Sanctuaries reserve the right to disqualify any participant from further participation in this Giving Day for Apes and future events if such participant engages in misconduct that affects the integrity of Giving Day for Apes or if such participant engages in any inappropriate or unacceptable behavior in connection with Giving Day for Apes.

Peer to Peer Fundraisers: Any participant may seek individual Peer to Peer fundraisers to raise funds on their behalf, and any online donations made to those fundraising pages on the Mightycause Giving Day for Apes website will be included in the participant's leaderboard total. Fundraising pages eligible to compete on the Peer to Peer leaderboard shall include those hosted by individuals or groups of individuals (such as a group of caregiver staff members, a group of the board of directors/trustees, etc.).

Use of the "Giving Day for Apes" Name and Logo: "Giving Day for Apes" is an event hosted by the Global Federation of Animal Sanctuaries and sponsored by the organizations identified on the Giving Day for Apes website. Participants will not use the "Giving Day for Apes" name and/or logo for other online fundraising events.

No Goods and Services in Exchange for Donations to Charitable Causes: Federal law prohibits charities from promising or providing goods and services (e.g., tickets to events or raffles) in exchange for making a donation. Participants may only accept pure contributions and not part gift and part sale transactions. Small tokens of gratitude, such as keychains, stickers, buttons, and so on, may be offered to donors as long as they are not offered in exchange for donations, and do not meet the conditions for a raffle or sale. Such items must be of insubstantial value, as defined by IRS Rev. Proc. 90-12, Section 2, Paragraph 1 (https://www.irs.gov/pub/irs-tege/rp_1990-12.pdf).

Terms of Participation

All organizations participating in Giving Day for Apes (Participants) must meet the following requirements. Submitting a registration form for Giving Day for Apes certifies that your organization meets and agrees to these requirements. Please review these terms carefully, as any Participant that is found to be in violation of these Terms of Participation may be removed from the event at the discretion of Global Federation of Animal Sanctuaries (GFAS).

Transfer Practices

Apes and other animals are not transferred from the Participant to individuals, sanctuaries, or other facilities that lack the appropriate expertise and/or resources and/or facilities to care for them. Before transfers, your sanctuary/rescue center is convinced that the recipient has the expertise, records management capabilities, financial stability and facilities required to properly care for the animals. Animals are not ‘loaned’ to other facilities.

Euthanasia Practices

Euthanasia is only used in the best interest of the animal and is not used as a management tool to create space.

Breeding Practices

No intentional ape or other animal breeding occurs, and sound practices are in place to prevent propagation. An exception may be made for rehabilitation and release centers engaged in a bona fide breeding-for-release-program with available and appropriate release sites, conducted with specific conservation goals, in accordance with local, state/province, national, and international law and regulations.

Acquisition Policies

Acquisition of apes and other animals occurs through donation, rescue, or confiscation. No commercial trade in sanctuary/ rescue center animals occurs (including, but not limited to, the sale or purchase of animals, animal parts, by-products, or offspring), and the sanctuary does not knowingly engage a third party to purchase an animal on its behalf.

Contact Practices

No direct contact between the public and apes or other wildlife occurs, including being allowed to hold, carry, or walk with animals. This includes entering enclosures with apes or other wildlife. In certain rehabilitation/ reintroduction programs, with young orphaned animals, volunteers who are suitably trained and part of the facility’s structured volunteer program may assist staff in carefully structured programs that ensure the safety and well-being of both the animals and the volunteers.

Marketing Practices

The sanctuary/rescue center does not engage in any activity, either in direct view of the public or through publication of photos and other materials, that suggests apes or other wildlife are appropriate pets. This includes but is not limited to: photos in which staff or others are shown holding or petting animals; and having animals on leashes or dressed in human clothing. In situations where text, photos, video or other media are published portraying personnel in direct contact with wildlife, steps should be taken to add text to the publication (website, brochure, etc.) that explains the reason for the contact and discouraging the idea that the animals would make suitable pets. Participants are requested to review the IUCN/SSC Primate Specialist Group’s Best Practice Guidelines for Responsible Images of Non-Human Primates, available here in numerous languages, and to share these guidelines with their personnel and anyone assisting them for this Giving Day for Apes. Participants may be asked to remove images from their individual fundraising pages that are deemed to be inconsistent with these guidelines. Participants are also expected to review any peer-to-peer fundraiser pages set up on their behalf and to request removal of any images inconsistent with these Terms of Participation.

Research Practices

No resident animals are made available for participation in research studies unless the studies are strictly observational, do not negatively impact individual animal welfare, and do not interfere with the normal daily activities of individual animals. Interventions that cause pain or distress are not acceptable.

Licenses and Permits

The sanctuary/rescue center has all of the required licenses and permits to operate.

Additional Terms

In addition to the Terms specified above, Participants agree to comply with the General Rules for this event.

Global Federation of Animal Sanctuaries (GFAS) can modify any restrictions or conditions if, in the sole judgment of the Board of Directors, such restriction or condition becomes unnecessary, incapable of fulfillment or inconsistent with the charitable needs of the community. GFAS reserves the right to deny or condition the distribution of prize grants if, in the judgment of its Board of Directors, such restriction or condition becomes necessary. Prizes will be sent separately from disbursements for funds raised on Giving Day for Apes.
